Laminate Countertop Warranty
Laminate One (1) - Year Limited Warranty
Sage Surfaces, LLC (“Seller”) warrants that, under normal use and service, all laminate products supplied by Seller shall be free from defects in materials and workmanship for a period of one (1) year from the date of sale in the United States to the first consumer purchaser for installation in the United States. This is the exclusive warranty for such products and applies only to properly installed products under normal use and wear. In the event that a Seller supplied product does not conform as warranted, the purchaser’s sole remedy shall be limited to repair or replacement of all or any part of the product (at Seller’s sole discretion) that does not conform. This limited warranty applies only to a product in its original installation and only if purchased by the first consumer purchaser. This limited warranty is not transferable and expires upon resale or transfer by the first consumer purchaser.
This limited warranty shall not apply to defects or damage arising from any of the following:
- accidents, abuse or misuse;
- exposure to temperature in excess of 200°F;
- improper fabrication or installation;
- improper maintenance including damage from abrasive cleaners or harsh chemicals;
- damage due to moisture.
The following costs and expenses are not covered by the provisions of this limited warranty:
- costs for the removal and re-installation of the products;
- shipping and freight expenses required to return the products to Seller;
- normal maintenance;
- economic losses;
- cost of plumbing disconnect or reconnect;
- incidental damage related to removal or reinstallation process.
NO OTHER WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, ARE MADE, INCLUDING, BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. UNDER NO CIRCUMSTANCES SHALL SELLER BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM THE PURCHASE, USE OR INABILITY TO USE ITS PRODUCTS, OR FOR ANY SPECIAL, PUNITIVE, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES. NO DEALER, DISTRIBUTOR, FABRICATOR, INSTALLER, AGENT OR EMPLOYEE OF SELLER HAS THE AUTHORITY TO ADD TO OR MODIFY THE OBLIGATIONS OR LIMITATION OF THIS LIMITED WARRANTY.
THE FIRST CONSUMER PURCHASER’S EXCLUSIVE AND SOLE REMEDY ON ACCOUNT OF, OR IN RESPECT OF, THE PRODUCTS THAT DO NOT CONFORM TO THIS LIMITED WARRANTY WILL BE THE REPAIR OR REPLACEMENT OF THE PRODUCTS, AT SELLER’S OPTION. IN NO EVENT WILL SELLER’S MAXIMUM LIABILITY EXCEED THE AMOUNT PAID FOR THE NONCONFORMING PRODUCT ONLY EXCLUSIVE OF FABRICATION AND INSTALLATION COSTS. NO REPLACEMENT UNDER THE WARRANTY SHALL EXTEND THE ONE-YEAR WARRANTY PERIOD.
